LetsCloud Inc. - DMCA Takedown Policy


LetsCloud Inc. ("LetsCloud", "we", "us") respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act of 1998, the text of which may be found on the U.S. Copyright Office website at http://www.copyright.gov/legislation/dmca.pdf, LetsCloud will respond expeditiously to claims of copyright infringement committed using the LetsCloud service and/or the LetsCloud website (the "Services") if such claims are reported to LetsCloud's Designated Copyright Agent identified below.

1. Designated Copyright Agent

If you are a copyright owner, or are authorized to act on behalf of one, or authorized to act under any exclusive right under copyright, please report alleged copyright infringements taking place on or through the Services by completing the following DMCA Notice of Alleged Infringement and delivering it to LetsCloud's Designated Copyright Agent.

2. Procedure for Reporting Copyright Infringement (DMCA Notice)

To file a notice of infringing material on the Services, please provide a notification containing the following details (a "DMCA Notice"):

  1. A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
  2. Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works at a single online site are covered by a single notification, a representative list of such works.
  3. Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit LetsCloud to locate the material. For a hosting provider like LetsCloud, this must include specific URLs, IP addresses, or other unique identifiers for the content in question.
  4. Information reasonably sufficient to permit LetsCloud to contact you, such as an address, telephone number, and, if available, an email address.
  5. A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  6. A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

Deliver this Notice, with all items completed, to LetsCloud's Designated Copyright Agent.

3. Upon Receipt of a Valid DMCA Notice

Upon receipt of a proper DMCA Notice, LetsCloud will:

  • Remove or disable access to the infringing material.
  • Notify the user whose content has been removed or disabled ("the User").
  • For repeat offenders, LetsCloud will terminate the User's account pursuant to our Repeat Infringer Policy (Section 5).

4. Procedure for Filing a Counter-Notification

If a User believes that the material that was removed or to which access was disabled is not infringing, or the User believes it has the right to post and use such material from the copyright owner, the copyright owner's agent, or pursuant to the law, the User may send us a counter-notification containing the following information:

  1. A physical or electronic signature of the User.
  2. Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or disabled.
  3. A statement under penalty of perjury that the User has a good faith belief that the material was removed or disabled as a result of mistake or a misidentification of the material.
  4. The User's name, address, telephone number, and, if available, an email address, and a statement that such person or entity consents to the jurisdiction of the Federal Court for the judicial district in which the User's address is located, or, if the User's address is located outside the United States, for any judicial district in which LetsCloud is located, and that such person or entity will accept service of process from the person who provided notification of the alleged infringement.

If a counter-notice is received by the Designated Agent, LetsCloud will send a copy of the counter-notice to the original complaining party informing that person that it may replace the removed material or cease disabling it in 10 business days. Unless the copyright owner files an action seeking a court order against the User, the removed material may be replaced or access to it restored in 10 to 14 business days or more after receipt of the counter-notice, at our discretion.

5. Repeat Infringer Policy

It is the policy of LetsCloud to terminate the user accounts of those who are determined by us to be "repeat infringers." A repeat infringer is a user who has been notified of infringing activity more than twice and/or who has had user content removed from our Services more than twice.

6. Modifications

We reserve the right to modify this policy at any time. Any changes will be posted on this page.
